Amanda Knox Trial Nears 3rd Verdict
FLORENCE, Italy January 29, 2014 (AP)
By COLLEEN BARRY Associated Press
http://abcnews.go.com/International/wir ... t-22280744

"We wait for the verdict, and remain hopeful," Knox's U.S. lawyer, Theodore Simon, said by telephone from Philadelphia. "But history being our guide, we know Amanda can be convicted and it is very disconcerting to her and her family. The logical position is that there is no evidence."

"I don't remember any case which has been as highly publicized and where the countries have taken sides," noted defense attorney Alan Dershowitz, who has written about the case.
"I think it's fair to say that the vast number of Americans think she is innocent and a substantial number of Italians think she is guilty," he said in a telephone interview.

Sollecito to appear in Florence court for new sentence
29/01/2014

Raffaele Sollecito will appear in a Florence court to await a possible new sentence in a trial for the 2007 death of British student Meredith Kercher, Sollecito's father told ANSA on Wednesday.

"I asked him to accompany me, and so we will be in the courtroom," Francesco Sollecito told ANSA, adding that it had not yet been decided if his son will make any statements before the panel of judges withdraws to the council chamber. "We will be there because once more we have faith in the justice system," the father said, and "out of respect" for the middle appeals court of Florence.

Here again is the link to today's article in the New York Times:

Knox Opts for Absence as Italian Court Nears Ruling in Murder Trial

“I’m not that person, I am very clearly not that person that’s being described,” said Ms. Knox, who feels that she can better defend herself through interviews mostly given to Italian and American news media, as well as through her 2013 memoir and her blog.
...
“People who accuse me argue that justice cannot be done for Meredith unless I am convicted,” she said. “It’s a mind-set where there are criminals and there are victims, and if you’re accused of being a criminal there’s no way you can be a victim.”

THE NEW YORK TIMES

Very curious: Knox feels she can better defend herself on the Internet than in a courtroom. :?

Man wrongly accused of killing Meredith Kercher by Amanda Knox challenges her to travel to Italy for verdict of latest retrial
By Nick Pisa
29 January 2014

The barman wrongly accused by Amanda Knox of murdering a British student has urged her to come to court 'if she is as innocent as she claims' - just hours ahead of a verdict in her appeal trial.

Speaking ahead of Thursday's verdict, he said: 'If she (Knox) is innocent she should come to court for the decision.' 'I will be there. If she is so sure that she had nothing to do with it, then she should be in court to hear the judges decision.'
...
'I haven't even been paid any compensation by her that I'm owed.'

This is actually rant-worthy. It makes me sick, really. Papa asks Raffaele to accompany him to Raffaele's own appeal process, and so he will show up. How generous of Sollecito to make an appearance, for papa's sake.

The rat-weasel is involved up to his crooked eyebrows in the brutal, senseless murder of Meredith Kercher, and he has kindly decided to put in an appearance tomorrow. Please stop me. Stop me now. It's just plain sickening.

Quote from Colleen Barry's article (p.2):

Quote:
Legal experts agree that it is unlikely that Italy would seek extradition until there is a final verdict. Still, Markus Witig, a trial lawyer in Milan with expertise in extraditions, said Italy could — but probably would not — seek immediate extradition on grounds of urgency, which could include the risk a defendant would disappear.

Dershowitz believes double jeopardy would not be an issue because Knox's acquittal was not a final judgment. He also doubts that the United States would want to set a precedent by refusing to extradite her if she is convicted, given that the United States makes frequent extradition requests for defendants sought by U.S. courts.

New revelations:

Lovestruck fan's Facebook fury for accused killer of Meredith Kercher after she discovers Raffaele Sollecito 'flirted' with her AND another girl online
By Mark Duell

A 25-year-old Australian woman today told MailOnline of her distress at learning Amanda Knox’s ex-boyfriend was allegedly having an online relationship with another woman at the same time as her.

Now, the woman from Melbourne - who does not wish to be named - has revealed her Facebook conversations with the 30-year-old Italian, in which he told her: 'I look at you as a girl and I fancy'.

But she has been left ‘upset and disappointed’ after finding out Sollecito - with whom she exchanged 2,000 messages - was also flirting with another girl called Kelsey Kay around the same time last year.

Well, as none actually got as far as signing the contract, I'd say at least a dozen. He was looking for a quick exit not a 'quickie'. He'd be stringing along any dope or fame seeker from a likely foreign haven that he could get his internet hands on and juggling the balls to keep them in the air as he tried to get each in turn to sign up. Looks like he ended dropping the lot and has to go with Papa to court tomorrow after all.

Haha....RS prooves he is no Romeo. Several women around the world and he could not find one daffy enough to marry him. Welcome to the circus...
RIP Meredith Kercher...this is all for you and family.
Speaking of Kelsey, she was very ready to supply more info about RS, so I doubt she believes in his innocence. I think at this point she want to pull his hair...one by one. Still feel for her...

Thanks Nell. Feel better Kelsey. Have a good life Kelsey. pp-(

I view them both as having very problematic characters. Yes, Sollecito has once again confirmed what he is capable of in order to avoid the consequences of his actions. Kelsey is revealed as willing to break the law if it suits her.

Sollecito was attracted to both Knox and Kelsey for a reason, he wanted instant intense relationships with both, and I don't think it is because that have completely opposite personalities. I think it's because they both have a complete disregard for the law.

With you on that. But Kelsey has child, so I hope she can mature well. pp-(

He didn't have any wishes to address the court one last time before the prosecution requested precautionary measures.

I think it's safe to say it was too late for him at that point to leave Italy. Given the circumstances he tries to at least leave a good impression on the court. Not more.

Amanda Knox verdict puts US credibility on trial
By Kieron Monks, Metro World NewsPublished: January 29, 2014
http://www.metro.us/newyork/news/nation ... -on-trial/

“No standard appeal is available for an extradition,” Christopher L. Blakesley, professor of international law at University of Nevada, Las Vegas, told Metro. “Her defense might try to argue that the second trial and appeals violated double jeopardy. This would be problematic as the U.S. understood the nature of the Italian criminal justice system when it entered into the treaty, assuming that it met due process standards.”

Unless a clear flaw was shown in the Italian legal system, extradition proceedings could only stop at the State Department level, explained Julian Ku, international law specialist at Hofstra University, New York.

“It could become a political question as she has so much popular support. If the U.S. does not care about its extradition treaty with Italy, it might decide not to turn her over,” Ku said.

But that could be a costly decision in a sensitive climate, believes Ku.

“In general, the U.S. benefits from these treaties more than their partners, and the general policy is to cooperate where possible,” Ku said. “The [Edward] Snowden case could work against Knox – it just highlights that the U.S. needs these treaties, and it will be under pressure to comply.”

If the Florence court rules against Knox, she could pursue a similar route to the NSA whistleblower and seek asylum in a non-extraditable country. Even if it rules in her favor, there may still be a price to pay, as Kercher’s family could sue for the profits from her book.

It's 80 pages long. Written by the world's best experts. 80 pages. I have had way too many cups of coffee today. I can tell. I am so stunned by this bit of news that I am shaking. It HAS to be the coffee. Ergon has often told us to expect surprises, but this one takes the cake. 80 pages. I'm going to be saying this in my sleep.

Love and fortitude to the Kercher family, now and forever. hugz-) Never have I seen such a strong, bonded and beautiful family. Meredith was an awesome part of that, so uselessly and selfishly taken away.

Oh wow, unbelievable. What a 'great' team of experts: Steve Moore, Judge Heavey, John Douglas, Mark Olshaker.

Tom Wright wrote:
I thought it was really important that another view was presented by third party experts, they could observe all the assailant points in a reasoned rational manner.

Oh yeah, those 'experts' are truly impartial and independent, very rational in their untiring support of Amanda Knox.

Tom Wright wrote:

I'm sure they are the very best, aka "crème de la crème" [/sarcasm off]. He must be joking. I'm beginning to get nauseous from all the damage control PR, emanating from Camp Knox, because it stinks. tu-)) And this last-minute attempt won't help the murderous duo a bit. Roll on Judgment Day! Re this 80 page 'book' by Tom Wright, the Mirror is very funny.

"But Tom, who has known Knox, 26, since she was an infant"

"we knew Amanda from middle school onwards"

If this is the standard of writing one can expect from the book, I'll pass; suffice to say the infantilization of Amanda Knox continues apace.

But if I called MY middle-schooler an 'infant' she'll give me The Look, that peels rhino hide at 20 paces.

Nick Pisa's tweets from Florence:

Sky nick pisa ‏@NickPisa 10h
In Florence for #Knox verdict and just bumped into her co accused #Raffaele #Sollecito at my hotel. How bizarre is that?

Sky nick pisa ‏@NickPisa 7h
For those wondering #Sollecito checked in with a girl. Not his sister & they went to same room. She had her hair under white bobble hat.

Sky nick pisa ‏@NickPisa 7h
She was shorter than him & resembled pictures of his supposed new girlfriend Greta but couldn't be sure & we were not introduced.

Sky nick pisa ‏@NickPisa 7h
#Sollecito denied to me that he proposed marriage to US girl Kelsey Kay & claimed she was connected to criminality. "No comment" on trial.

Thanks G. What is late? I think the evening. I don't remember how long Massei took, but Hellmann was 10 hours I believe. Anyway, too late for me probably. Will read it tomorrow :)

I'm re-posting these two informative posts from .org. No time to search the news and look up the sources.

Post by Catnip » 29 Jan 2014, 22:28

There are now more than 500 journalists accredited to report from court on the case.
[il Mattino]

Raffaele’s father told ANSA news agency that he and Raffaele will be attending the hearing “out of respect for the Court”, and also because “once again we have faith in Justice”.
[Corriere dell’Mezzogiorno]
[Giornale dell’Umbria]

Amanda “is worried about what might happen”, Ghirga told ADN-Kronos news agency on the eve of the verdict.
[Focus]

Raffale’s father told Oggi magazine, about the Kelsey affair: «It was Kelsey who went looking for him, but when he had met up with her in Idaho he found out that she had tricked him: she was a young mother with a three-year-old girl and a companion in prison for drug dealing. And Raffaele would have proposed marriage to a woman like that?».

He also denied his son’s engagement with university friend Greta Menegaldo: «Neither matrimony nor engagement nor flight from authority are in Raffaele’s plans», he told Oggi, «but only his degree thesis in March at the University of Verona».

If there is a conviction, Sollecito risks arrest

"In the event of a conviction, the Deputy Attorney General, Alessandro Crini has requested precautionary measures for the defendants, while waiting for the verdict to become final. In Sollecito's case, there could also be an arrest--some people have interpreted his presence in the courtroom tomorrow as a kind of last-ditch attempt to convince the Judges that he has no intention of fleeing.

For Sollecito, in fact, any precautionary measure would take effect immediately. In the case of a travel ban, they would seize his passport immediately. In the case of home arrest, he would be granted a period of time to go home. In case of arrest, he would be taken immediately to prison. For Knox, however, those periods of time would be longer, and [would involve] US-Italy treaties."

Amanda Knox has written a letter to the Kercher family, but, fortunately, hasn't sent it yet!

Amanda Knox writes to the Kercher family: "In the letter, words of comfort." Stephanie , Meredith's sister: " I do not know if we will read it."
By Roberto Costantini

Google:

A letter of Amanda Knox for Stephanie , sister of Meredith Kercher , the student killed in Perugia on the night between the first and second of November, 2007 . But the envelope is closed.
...
A sealed envelope - "Amanda wrote you a letter, before the verdict , as if one day you will want it to be delivered."
...
Correct and realistic - Amanda is correct and realistic , she knows that she can not claim to be heard by Kerchers and at this time, maybe not even suggest it. In one of our exchanges via Skype ... she told me and written in Italian : " One of my communications to them, today , would introduce a lot of anxiety and suffering for the family, even if I write only words of comfort. "... She confirmed that we [she] will deliver the letter to the Kerchers at their request also after months or years , if she is found guilty or innocent. I am known to exist now , the last time before the verdict : the contents of the letter and its eventual delivery depend on the judgment . On that of Florence or , if there are any , from the later ones .
...
On the verdict of Florence Stephanie and Amanda have different anxieties but not the opposite . Stephanie said with admirable balance and serenity : " For over six years we have had to come to terms with this process and with the media uproar , and try to continue our lives ." She speaks to me from the office where she works, during a break for lunch. She continues: " The verdict is a deadline to honor the memory of Meredith , not a source of revenge or truth . We know that judges and jurors do not know with certainty the truth. We would like the process and the chatter around it to end now so we can just focus on our pain and the memory of Meredith. So , no one will give back my sister and our life is over. "

In Victor v. Nebraska (92-8894), 511 U.S. 1 (1994), the Supreme Court of the United States noted that:

"The beyond a reasonable doubt standard is itself probabilistic."

Accordingly, the Court endorsed a jury instruction on the nature of the BARD standard that reads as follows:

"...You may find an accused guilty upon the strong probabilities of the case..."

It can't make any difference anymore, not even if a new 80 page book is released.

Machiavelli's tweets (with a delay):

Machiavelli ‏@Machiavelli_Aki 47m
Let's make a short summary.

Machiavelli ‏@Machiavelli_Aki 45m
Dalla Vedova's talking lasted a short time, and not very orderly.

Machiavelli ‏@Machiavelli_Aki 44m
DV focused on evidence assessment procedure, quoted SC

Machiavelli ‏@Machiavelli_Aki 41m
D.V. emphasized the single pieces of evidence should be assessed each one in parceled out, atomized way before considering the whole

Machiavelli ‏@Machiavelli_Aki 40m
D.V. says believes there are other Supreme Court rulings in his favor.

Machiavelli ‏@Machiavelli_Aki 37m
Dalla Vedova asked acquittal, did not specify, whereas Ghirga instead, talking later, invoked reasonable doubt.

Oh, geez, I need to get some sleep but I can't even imagine what it must be like for the Kercher family... I am just nothing compared to their ongoing quest for beautiful Meredith. Please Meredith, if you can help from where you are, make it right. Sorry, but am almost crying right now... Stephanie is just so awesome with her intelligence and reserve. Godspeed.

Machiavelli's tweets (cont'd):

Machiavelli ‏@Machiavelli_Aki 37m
Ghirga recalled a small number of details of physical evidence and autopsy.

Machiavelli ‏@Machiavelli_Aki 34m
Ghirga talked about: Meredith's blue sweater, an echimosis at back of her head, DNA laboratories and Stefanoni's quantization

Machiavelli ‏@Machiavelli_Aki 33m
Ghirga: Meredith's blue sweater was removed before fatal stabbing, as for (per?) Torre's opinion. Admits he disagrees with Sollecito's defence.

Machiavelli ‏@Machiavelli_Aki 30m
Says bruise at back of head is compatible with frontal fight against single agressor (disagreement with Introna on this too)

Machiavelli ‏@Machiavelli_Aki 28m
Ghirga: cited the claims about picograms, said amount is not the point, the problem is test repetition and other conditions

Machiavelli ‏@Machiavelli_Aki 27m
Said no blood on knife because of negative TMB and blood confirmatory tests.

Machiavelli ‏@Machiavelli_Aki 24m
In point of law: Ghirga said evidence must be considered as a whole in compliance with SC, but assessment should find reasonable doubt

Machiavelli ‏@Machiavelli_Aki 21m
Ghirga emphasized discretional power of the court. Said they have big power to acquit.

Machiavelli ‏@Machiavelli_Aki 21m
Said because of the greatness of their power they should acknowledge reasonable doubt.

I am catching up with the forum posts after spending some time on Twitter following the courtroom tweets. Must have been a sad affair the presentation by Knox's start team. So quick. They didn't seem to have much to say. Nothing new at all. Everything presented has been already discarded by the ISC, so I expect a guilty verdict.

Hi Cape!

It's good to see you.

5 pm in Italy is 3 am where I live. Should you not hear from me it's because I lost the battle against fatigue.

Hey C, glad you're still among us & drawing breath. Missed you so! Good to see you back on this

important day. I say to the judges, convict the two bastards so we can all go home and resume

normal life again. This travesty has been going on for much too long.

Nick Squires' report for The Telegraph:

Stephanie Kercher said her family was not looking for “revenge” against Miss Knox, but simply wanted to discover the truth and bring a seemingly interminable legal process to an end.

“We want the trial to finish today so that we can concentrate on our pain and sadness and honour the memory of Meredith,” she told Corriere della Sera newspaper. “We’ve had to rely on the Italian judicial system, which for us is so different that it is almost incomprehensible.”

LIVE BLOG: Knox and Sollecito face Kercher murder verdict

12.05pm Speaking in court this morning Carlo Dalla Vedova, Amanda Knox's lawyer, said his client's innocence was "rock-solid".

"The knowledge of Amanda's innocence is now rock-solid and it allows us to await the verdict with serenity," he said, adding: "It is not possible to convict someone because they are considered 'probably' guilty."

10.00am Amanda Knox has sent a letter to Meredith Kercher's family, which has remained unopened, Corriere della Sera reported today. "We don't yet feel the need to speak to her," the victim's sister Stephanie Kercher was quoted as saying.

THE LOCAL

So, has she sent the letter or hasn't she? :?

Right. Almost 5.00 am my time. Will check in later to see if the Judges got it right. All I can hope for right now is a guilty verdict..and that the Kerchers sue for wrongful death.
AND..that KNOX will finally get the verdict that is CORRECT. As for Sollecito. Just as guilty.

Consensus is that extradition is almost inevitable if convicted. Are you aware of the Wiki? If not, definitely visit http://themurderofmeredithkercher.com. It is a fantastic resource.

Hi G, thanks for the blow-by-blow up thread. On top of things as always.

I had trouble getting onto .org 15 minutes ago. Didn't get the normal front page, had to log in to read (probably intentional). On now and seems fine.

It may be late before a verdict is reached. One would think that since the defense has not raised anything new they haven't already argued before Cassazione, the court would issue a verdict some time after dinner.

However, they will go over the issue of reasonable doubt with a fine tooth comb. Mixed DNA, the knives, the witness statements will contradict that tired argument. Given Nencini's reputation, I expect a tight, well considered motivations report which will be masterfully elegant.

Afternoon m'dears :) back for what I hope is the last instalment of this ongoing nightmare for all concerned....although some made their own nightmares and others had it forced upon them.

HUGS CAPEY, missed you sweetie :) much love to all for keeping the home fires burning, life has been getting in the way but I'm glad to be here for the final push.

The cynic in me says foxy has her preggers statement prepared and Sollecito has his 'amanda hit me twice on the head to get me to lie for her, I was so scared I imagined we were innocent' statement prepared.

Much love to the Kerchers on this awful day. I hope they get justice for meredith at last. xxxx

More on the letter:

On the day the deliberations began, an Italian journalist who is writing a book about the murder wrote that Knox has given him a letter addressed to the Kercher family to be given to the Kerchers if they are willing to accept it.

Roberto Costantini wrote in Corriere della Sera today that he spoke with Meredith Kercher's sister Stephanie several days ago about the letter.

He quoted Stephanie Kercher replying to the offer of the letter, "I will have to think. I don’t know, but today I don’t want to read it because I do not feel the need to speak with her now.”

Hi all. Thanks much for the court updates.

RS and Father making a big deal of being in court. In reality there is little point him being anywhere else given that he may be immediately arrested\put under house arrest\have his passport seized, with a guilty verdict.

Hoping that the Kerchers find peace of mind...

Amanda Knox and ex-boyfriend await verdict in latest trial

Knox's lawyer Carlo Dalla Vedova told the court he was "serene" about the verdict because he believes the only conclusion from the files is "the innocence of Amanda Knox."

"It is not possible to convict a person because it is probable that she is guilty," Dalla Vedova said. "The penal code does not foresee probability. It foresees certainty."

Dalla Vedova evoked Dante, noting that the Florentine writer reserved the lower circle of hell for those who betrayed trust, as he asserted that police had done in Knox's case when they held her overnight for questioning without representation and without advising her that she was a suspect in Meredith Kercher's murder.

That is an interesting tweet. So in the end, he chickens out, probably afraid he might be arrested.

I've read in a tweet today that one of the journalists met Raffaele Sollecito in the same hotel he was staying in. He wrote he saw Sollecito disappearing with a girl in his hotel room.

So first he books a hotel room and now he stays with relatives? I am not sure I believe that.

What an odd remark. How can anyone shut down the website for people that aren't members? It's on the internet and clicking on the url will open the page.

I see ... they must have the wrong server if the site can't handle the traffic.

That is easy to arrange by giving permissions to view a forum if you are a member or not. What it means is that he has disallowed unregistered users to view the forums. In order to see them, you have to log in.

I don't think non-membership is the issue with .org right now. I am supposedly currently logged in. I still can get the page I was on but get a "forbidden" message when I click on the page before and an "internal server error" message when I click on the page after. It is also "forbidden" if I bring up a new screen and try to log on again.

All my thoughts are with the Kerchers. I hope that they will soon be able to put the legal process behind them and simply mourn their daughter.

It's disgusting how since near the beginning of the investigation and trials, the Entourage and HangersOn (starting with disappeared "Kelly" and continuing with the rest of the barrel of monkeys) have told the Kerchers to put aside their grief and support the RingLeader.

Probably worth mentioning a few times, especially right before announcement. Also probably futile.

This is going to be an emotional announcement for many. And, if I have my stereotypes correct, Italians in particular should understand this.

OK, last time it was announced "no cheering please" was when Sollecito and Knox were acquitted and the Knox family clapped and cheered nonetheless.

Just feeling an overwhelming sense of relief. I wanted to cry when I saw the Kerchers in court today.
Here's hoping that they will find some sense of peace. What else can be said?
Loonies on the internet are saying that she'll never go back, as if that means that Knox has won something.
She and Sollecito now carry the mark of convicted murderers. I believe that is indelible. No matter where they go or don't go.

Was 403'd a while back, but all is well. Congratulations to the Kerchers, and may their healing begin.

Justice was served today.

Hi guys,

After a lot of fussing and fighting I got us back online again. Hopefully we shouldn't have this issue again as traffic will be much calmer. Fingers crossed. It's great to be back :)

Sigh. One day, it will be really nice to able to live without lurching from one disaster to the next.

I just want to say, it was really nice to see lots of old faces popping in today. Meredith is not getting justice in a vacuum. For many, she is not forgotten and never will be.

A day of mixed emotions. The interview with Stephanie and Lyle particularly poignant:

The Guardian features an interview with Amanda Knox and Madison Paxton (approx. 12 minutes).

They say they accompanied her during the four or five days leading up to the verdict. An odd moment to conduct interviews. One would have thought she would prefer to have a bit of privacy in such a stressful time.

I couldn't watch it to the end. Knox describes how the mean police investigating a homicide didn't let her call her mom, her phone was ringing right in front of her and the only thing she wanted was to talk to her mom. Then she tries to tear up but it takes too long, so she keeps repeating "I just wanted to talk to mom, since I was a kid ... my mom. All I wanted was my mom."

She is also angry at the media who say this case is a mystery. According to her it is not, the black guy did it. It's that easy.

I second that. It is nice to see how many people care that justice will be served in this sad case.

There was a lot of activity on Twitter as well. The PR hasn't worked as well as they hoped.

I couldn't get past the ringing phone, "I want my mom", bit either.

I don't know why she thinks the media consider this a mystery. There is no mystery. It's solved, and has been for years. Her attempts to run interference failed miserably.

Does anyone else find that Knox's voice is hard and forceful? I haven't watched any of her previous interviews because I'm not interested in what she has to say. Today, I was curious about what she had to say, and her harsh voice was the one thing that stood out for me in her 5-day pre-verdict interview. I can understand why people would have been crawling the walls when she wouldn't stop singing in prison.

Where will she run to?

Yeah, people who despite their best efforts couldn't rig it. What a shame!
